Terms of Service

You must be at least 13 years old to use FishNerd. If you are under the age of majority where you live, you may use the App only with the consent of a parent or guardian.

You are responsible for your account and for keeping your sign-in credentials secure. You are responsible for the activity that happens under your account.

You keep ownership of the photos, catches, and other content you add ("Your Content"). You grant FishNerd a non-exclusive, worldwide license to store, process, and display Your Content solely to operate the App and according to the visibility you choose for each catch. You are responsible for Your Content and confirm you have the right to share it.

You agree not to:

• break the law or fishing regulations, or encourage others to;
• upload content that is illegal, harmful, or infringes someone else's rights;
• misuse, disrupt, reverse-engineer, or attempt to gain unauthorized access to the App;
• scrape or harvest data, or use the App to build a competing dataset or product.

FishNerd provides species identification, weather and environmental conditions, and best-effort summaries of local fishing regulations. This information is generated automatically, may be inaccurate or incomplete, and is provided for convenience only. It is not legal advice and is not a substitute for official sources.

You are solely responsible for knowing and following all applicable fishing laws, licenses, seasons, size and bag limits, and safety practices. Always verify regulations with your local fish and wildlife authority before keeping or releasing a catch. Fishing and boating involve inherent risks, and you participate at your own risk.

The App relies on third-party services (for example, hosting, sign-in, species identification, weather, and maps). Their availability and accuracy are outside our control, and your use of them may be subject to their own terms.

The App, the FishNerd name and logo, and its software and design are owned by MCFM REALTY LLC and protected by law. These Terms do not grant you any rights to our trademarks or branding.

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or to protect the App and its users.

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate.

To the maximum extent permitted by law, MCFM REALTY LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the prior twelve months or US $50.

You agree to indemnify and hold MCFM REALTY LLC harmless from claims arising out of Your Content, your use of the App, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute that is not subject to arbitration or small-claims court.

We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the App after changes take effect means you accept the updated Terms.
